Professor Julien Chaisse’s Insight into Economic Warfare and Collateral Damage: The Adverse Impact of U.S. Laws on Allied Nations

On November 1st, 2024, ACWH’s Director Yueh-Ping (Alex) Yang, on behalf of the National Taiwan University College of Law, moderates the Chair Speech of Professor Julien Chaisse, titled “Economic Warfare and Collateral Damage: The Adverse Impact of U.S. Laws on Allied Nations.” Professor Julien Chaisse is a leading expert in international trade, investment, dispute resolution, and digital law and is currently a professor at the City University of Hong Kong School of Law and the Co-Editor-in-Chief of the Journal of World Investment & Trade and the Asia Pacific Law Review.

Professor Chaisse’s speech centered around the impact indirectly caused by U.S. laws on the allied countries during economic warfare. He gave insights on the extraterritorial effects of U.S. laws on global finance, trade, and technology. He used Australia’s AWB Case, Canada’s Meng Wanzhou Arrest Case, and Indonesia’s Hoskins Case to demonstrate how the application of U.S. laws as well as enforcement of sanctions pose impacts on non-U.S. individuals or entities. He emphasized that U.S. legal practices are currently used more as economic tools than security tools, which bring challenges for allied nations to balance their sovereignty with their diplomatic relations with the U.S. He finally reflected on the role of international laws and organizations in addressing related international law issues, including redefining the principle of jurisdiction and the concept of extraterritorial jurisdiction and playing as a moderator between the U.S. influence and countries’ sovereignty.
